5 things to know about working hours and overtime in the UAE

Dubai: If you are a full-time employee in the private sector in the UAE, it is important to know the maximum working hours in the UAE and your rights to overtime and to be paid.

Articles 17, 18 and 19 of the UAE Labor Law Federal Decree No. 33 of 2021 regulate how working hours are calculated and the maximum hours a worker may work before being entitled to rest.

Here are five key points to remember.

1. Normal working hours are 8 hours a day, 48 hours a week

On 20 January, the Ministry of Human Resources and Emiratisation (MOHRE) published a post on its official social media accounts, specifying four important aspects related to working hours in the private sector in the UAE:

1. Normal working hours are 8 hours a day or 48 hours a week

2. Commuting time to and from get off work is not counted as working hours, except for special circumstances and within the scope of control stipulated in the implementation rules.

3. For part-time work, the working hours are stipulated in the labor contract.

4. The continuous working time shall not exceed 5 hours, and the rest time shall not be less than 1 hour.

Article 15 Cabinet Resolution No. (1) of 2022 highlights three situations where commuting is included during working hours:

A sort of. Any delays caused by crews in transit, encountering severe weather, and responding to warnings from the National Weather Center regarding weather changes and fluctuations.

b. Any delay of the worker in the transport provided by the employer in the event of a traffic accident or emergency breakdown.

c. If both parties expressly agree on this in the contract.

3. Overtime work shall not exceed two hours a day

according to Article 19 According to UAE labor laws, employers can require employees to work overtime provided that the overtime hours do not exceed two hours a day.

Article 19(1) of the UAE Labor Law

An employer may direct a worker to work overtime during normal working hours, but not more than two hours per day, unless such work is necessary to prevent serious loss or serious accident or to eliminate or mitigate its effects. In no case shall the total working hours exceed one hundred and forty-four hours in a three-week period.

4. Overtime pay is 25% to 50% higher than the base pay for normal working hours

According to u.ae – the UAE government’s official information portal, if the nature of the job requires workers to work outside normal working hours, then they will be entitled to pay equal to the normal working hours, which is based on basic wage wages, plus 25% of the salary.

It may increase to 50% if overtime is done between 10pm and 4am. This rule does not apply to workers who work in shifts.

5. You may not always be entitled to overtime pay

You may not be eligible for overtime pay if your occupation or position with the company falls into certain categories listed as exceptions in the UAE labor laws.

Article 15, Item 4 It was explained in Cabinet Resolution No. (1) of 2022 that overtime pay may not apply depending on the worker’s occupational type or seniority in the company position. According to the article, the following categories are exempt from the regulations on maximum working hours:

Job position:

A sort of. Chairman and Members of the Board.

b. Persons in supervisory positions, if such positions confer upon them the powers of their employer.

c. Naval ship crews and seamen who enjoy special conditions of service due to the nature of their work.

d. Personnel engaged in continuous work in continuous shifts for technical reasons, provided that the average working hours per week does not exceed 56 hours.
