UAE Law: Can I continue to work from home during Covid-19? – information

The UAE Ministry of Human Resources allows employers to adopt remote working systems during the pandemic.

problem: I work for a company in Dubai. I am a bit paranoid about the general situation of Covid-19. In addition, I have elderly parents who live with me. Can I request to continue working from home? What if my company insists that I work in the office?

Reply: The UAE continues to respond to the Covid-19 pandemic in a way that is recognized and highly appreciated around the world. The UAE has achieved a perfect balance in protecting lives and the economy.

Based on your inquiry, we assume that you are employed by a mainland company in the Emirate of Dubai. Therefore, the provisions of Ministerial Resolution No. 279 of 2020 on the employment stability of private sector enterprises during the application of preventive measures to prevent and control the novel coronavirus epidemic (“Ministerial Resolution No. 279 of 2020”) shall apply.

It should be noted that due to the impact of the epidemic, the Ministry of Human Resources and the Emirates (MOHRE) issued the 2020 Ministerial Resolution No. 279 on March 26, 2020, and the provisions of the resolution still apply. MOHRE allows employers to adopt remote work systems during the pandemic.

This is in line with Article 2(1) of Ministerial Resolution No. 279 of 2020, which stipulates: “Enterprises affected by the above preventive measures wishing to reorganize their employment relationship shall gradually adopt the following measures and reach an agreement with non-national employees, as follows:

1. Apply remote working system. “

According to the above-mentioned laws and regulations, if your job does not necessarily require you to be in the office, you can ask your employer to allow you to work at home while remembering that your elderly parents live with you. However, if your employer requires you to work in an office based on their requirements, then you may have to do so.

Employers in Dubai may require all their employees to work in their offices because the emirate has allowed all offices to work at 100% capacity. If your employer insists that you work in the office, employees must follow Covid-19 safety precautions, such as wearing masks, keeping a safe distance from each other, and washing or disinfecting hands regularly. Your employer also needs to disinfect the office premises on a regular basis.
