Bill Paxton’s family files legal action against hospital over his death

The family of late actor Bill Paxton have agreed to settle their wrongful-death claims against a hospital and a surgeon who performed heart surgery shortly before his death in 2017.

A legal action filed more than four years ago against Cedars-Sinai Medical Center in Los Angeles was scheduled to go to trial next month, but lawyers for Paxton’s wife Louise and their two children filed a lawsuit Friday in the city’s Superior Court. A notice said they had agreed to close the case.

The terms of the settlement are confidential, with the family’s legal team saying only: “The matter is settled and both parties are satisfied.”

The agreement still needs to be approved by a judge.

Paxton, 61, who starred in films including Apollo 13, Titanic and Alien, died on February 25, 2017.

According to his death certificate, the cause was a stroke 11 days after surgery to replace a heart valve and repair damage to the aorta.

A legal complaint filed a year later said the surgeon used “high-risk and unconventional surgical methods” that were unnecessary, that he lacked experience in performing it, and that he downplayed the risks of the surgery.

The misguided treatment resulted in Paxton suffering from excessive bleeding, cardiogenic shock and coronary damage, the operation purportedly says Cedars-Sinai knew that surgeons tended to “perform maverick procedures and demonstrate suboptimal judgment” “.

The defendants said in court documents that Paxton and his family knew and understood the risks involved with the surgery and voluntarily went ahead with it. The defendant said there was no negligence that led to his death.

Born and raised in Fort Worth, Texas, Paxton was one of the busiest actors in the industry from the early 1980s until his death, amassing nearly 100 credits and starring in Twister and Weird Science.
