The Abu Dhabi Family and Civil and Administrative Court case dismissed a lawsuit brought by a woman in which she demanded a man pay her Dh542,000 on the grounds that she lent him but he did not return it, except for 12% interest, fees and expenses, and attorney fees, in addition to legal fees.
The woman claimed that she had known the respondent for a long time and trusted him, so she lent him Dh542,000 and he demanded repayment of the debt, as he claimed.
She also confirmed that the respondent promised to return it as soon as possible, but he didn’t, so she asked him to pay, but he didn’t respond.
The appellant attached messages to the social networking app WhatsApp and to her bank account statement.
Respondent denied the woman’s claims, and his attorney confirmed that his client refuted the scanned images and denied that he had any connection to them. He asked the appellant to submit original drawings, dismissed the case, and ordered it to pay fees and attorneys’ fees.
He also requested the appointment of an information and communications technology expert to examine the images and attest to their authenticity.
The court said that the appellant had only provided a copy of the WhatsApp message, which contained no evidence to support the appellant’s claim and did not include the fact that the appellant admitted to receiving the cash.
The court also noted that the statement submitted by the appellant showed that she had withdrawn cash from the account, and the case file had no evidence that she had delivered the money to the appellant, so the court dismissed the appeal. and requires the appellant to pay the litigation costs.
