Police, lawyers explain fines and penalties in hit-and-run cases

Law enforcement authorities have warned motorists in the country not to flee accidents that cause injury or death. They encourage motorists to notify police.

A senior official from the Dubai Traffic Prosecution Service said there have been 717 crashes in which victims have been knocked down over the past few years. This resulted in the casualties of several victims of different nationalities.

Multiple hit-and-run accidents have also been reported across the country since last year. The official added that hit-and-run is a misdemeanor, but can become a felony if it results in death or injury.

Dr. Hassan ElHaiss, Advocate and AlRowaad Advocate and Legal Adviser explained that the UAE government has promulgated Federal Law No. 21 of 1995 on traffic control in the UAE and emphasised the imposition of fines on individuals who commit traffic offences. It is clear that the UAE has a zero-tolerance policy towards any hit-and-run cases and requires all drivers involved in an accident to be obliged to report the incident immediately to the police.

According to the provisions of Article 5 of the Traffic Law, a driver who has a traffic accident shall report to the police and hand over the relevant certificates of the motor vehicle that caused the accident and the certificates of other vehicles and persons or materials related to the destroyed property. .

Importantly, the driver should notify the police within 6 hours of the accident if the police are not near the accident. First, drivers of the two vehicles that caused the accident or were struck by another vehicle should immediately move out of the way and park in a safe place on the side of the road to prevent further traffic on the road. In another situation, if you are hit by a motor vehicle as a pedestrian and the driver is trying to flee the accident scene, you should immediately take down the vehicle’s license plate.

Second, if you need to use an ambulance at the scene of an accident, you should call 999 for immediate action. Importantly, you can take photos and videos of damaged vehicles, but not individuals, as clicking on images and videos of an individual without his or her consent is a violation of cybercrime laws.

Recent hit-and-run accidents

On October 24, Sharjah police arrested an Arab driver in his fifties in a hit-and-run accident. The driver ran over an Arab in his thirties, killed him on the spot, and fled.

At 3pm on Sunday, the operating room received reports of a rollover accident on Al Taawun Street in Sharjah, in which a man died and the driver fled. Sharjah Police conducted a manhunt for the driver and managed to identify and arrest him within five hours. He confused his guilt and was referred for prosecution.
