UAE: Ministry finds nearly 3,000 cases of wage breaches in 10 months – News

Inspectors made 485,000 visits to private sector facilities across the UAE between January 2022 and October 2022, and Human Resources and the Emirate (Mohre) recorded 26,104 breaches of labour laws.

“Legal action has been taken against the violating entity and related fines have been imposed,” it said.

Of these labor violations, there were 2,973 cases of non-compliance with wages. These were referred to the Public Prosecution for further legal action. There were 178 cases of employers withholding employee passports, and 132 cases were closed.

The offences also include cases where recruitment fees are deducted from workers’ wages. About 30 workers signed false documents receiving wages and entered incorrect data into the Paycheck Protection System (WPS) to circumvent the rules. Two cases of sexual harassment were also reported.

Mohsen Al Nassi, Mohre’s Acting Assistant Under-Secretary for Ombudsman, said: “The inspection visit is based on the transparency and impartiality of the ministry’s inspectors, who have a deep understanding of the laws and administrative regulations governing labour relations, particularly with regard to employers and workers’ rights and obligations.”

The Ministry imposes administrative fines on violations found during inspections. These included 22,087 cases of non-compliance with procedures for issuing work permit contracts and facilities not engaging in licensed activities; 21 coordinating and employment agency activities without the necessary permits; and 14 cases failing to meet approved labor accommodation standards.

In 165 cases, companies failed to ensure relevant working conditions for workers in open areas. In 17 cases, the Ministry was not notified of work-related injuries, occupational diseases or deaths of on-duty workers.

The Ministry’s inspectors have statutory powers to issue violations against non-compliant entities and to prepare reports detailing the violations.

The official praised most employers’ commitment to labor market legislation, which “confirms their awareness of the impact of these legislation, particularly in terms of stabilizing work relationships and improving overall productivity.”

How the inspection is carried out

Labour inspectors have the right to enter at any time any facility subject to labour relations management laws to conduct inspections. They can call employers or their representatives to factory headquarters, labor dormitories or departments.

Inspectors are empowered to conduct inspections or investigations as necessary to verify the safety of the employer in fulfilling its legal obligations; to question employers or workers individually or in the presence of witnesses; to review documents and data that employers must keep and obtain printouts if necessary parts; sampling inspections of materials used or circulated in industrial processes and other jobs.

If necessary, inspectors may request medical examinations and studies of workers in the facility to ensure the suitability of working conditions and their impact on workers’ health.
