The Ministry of Human Resources and Emiratisation (MoHRE) and the UAE Competitiveness Council (Nafis) have started imposing fines and penalties related to false Emiratisation data.

A UAE resolution provides a comprehensive legal framework to limit negative practices that affect the realization of Emiratisation goals and policies. Penalties vary according to the nature of the business’s violation.

According to the resolution, if an institution conducts false Emiratization to obtain Nafis benefits, an administrative fine ranging from AED 20,000 to AED 100,000 per false Emirati employee will be imposed. Financial support and other benefits provided by Nafis will be suspended and amounts paid will be recovered.

The same penalties apply to companies that submit incorrect documents or data for the benefit of Nafis.

If the beneficiary does not attend work after the permit is issued and the company fails to report, an administrative fine of AED 20,000 per UAE employee will be imposed. The same penalty applies if the business fails to report to Nafis that the beneficiary has stopped working.

The authority is also entitled to recover the amount paid to the institution if the institution fails to designate a beneficiary after the Nafis-supported training period ends.
