A young man injured in an accident after fighting with the driver is seeking Dh51,000 in damages from his insurance company, but his suit has been dismissed on appeal.
The man said in the lawsuit that he was involved in a traffic accident caused by the driver of the vehicle, which resulted in multiple injuries to different parts of his body. The vehicle was insured by the insurance company he later sued.
The man and the defendant reportedly got into a heated argument as they were leaving a nightclub. When the man in his 20s got into the car, the driver immediately drove away, causing the man to fall to the ground and injured.
The plaintiff was then taken to hospital for treatment. The driver of the vehicle involved in the accident had earlier been convicted and fined.
The plaintiff said that while he was in the hospital, the treatment he was given had side effects, leading to serious complications in his left eye. This prompted him to file a civil suit against the hospital, the driver and the insurance company that insured the vehicle to jointly pay Dh51,000 for the physical, mental and material damage he suffered as a result of the accident.

The Medical Liability Commission had earlier reported that no error had been made in treating the young man.
The Abu Dhabi Family and Civil Administrative Claims Court of Appeal upheld the earlier ruling of the Abu Dhabi Court of First Instance dismissing the lawsuit against the insurance company, the third defendant in the case.
Considering that the plaintiff was injured due to an altercation with the driver of the vehicle, the accident was not covered by the insurance, so a ruling was made.
The young man challenged the appeal to the Court of Appeal, which upheld the lower court’s decision.
