Overpriced maid services fined up to $1,361.30, failure to refund

With the UAE’s new domestic worker law coming into force earlier this month, The government ensures that the recruitment process is regulated and leaves no room for unfair practices.

From working hours limits for maids, personal drivers and other domestic workers to how they are employed, the Ministry of Human Resources and Emiratisation has detailed all the rules that must be followed to ensure rights are protected and obligations are fulfilled.

Anyone who violates any of the legal provisions will be fined up to Dh1,000,000. Depending on the number of people involved in the violation, the fine can even increase to a maximum of Dh10 million.

In a tweet shared on Friday, Mohre detailed the administrative penalties that could be imposed on maid recruitment agencies that do not comply with the new law. These include fines for overpriced services and for failure to follow refund guidelines if employers choose to repatriate workers.

Below is a list of violations and corresponding penalties:

• Non-compliance with Mohre-approved service package prices or hiring from external electronic systems: fine of Dh5,000 each)

• Non-compliance with the form of contract approved by the Ministry (AED 5,000 fine per case)

• Present the CV of the domestic worker who violated the regulations or who complained about work interruption (AED5,000 fine each)

• Employment of domestic workers who do not meet the conditions for medical examination or issuance of a residence permit (a fine of AED 5,000 per case)

• Failure to clearly display to customers the price of service packages approved by the ministry (Dh2,000)

• Failure to comply with the requirement to refund all or part of the recruitment amount to the employer within the specified period, i.e. from the date the domestic worker returns to the establishment or 2 weeks from the date their absence is reported (Dh2,000 per case is good)

• When recruiting domestic workers from abroad, delaying their availability beyond the time agreed with the employer (Dh100 per day of delay, up to a maximum of Dh1,000)
