Authorities said the complainant had not called for an investigation into the matter to prove wrongdoing
Abu Dhabi court has dismissed a lawsuit brought by a motorist against a shopping mall for damages after she parked her vehicle in the mall’s car park.
The woman has filed a lawsuit seeking Dh17,500 in damages from the mall, including Dh12,500 for repairs to her Lexus and Dh5,000 in moral damages.
According to the woman, she parked her car outside the parking lot of the mall, and when she entered the mall to shop, an iron ball belonging to the mall moved from its original position and hit her car.
The woman complained to mall management and asked them to fix her vehicle, but they refused to resolve the issue amicably.
She then reported the damage to her car to an agency and took the matter to court with a copy of the report listing all the damage to her car.
However, the Abu Dhabi Family and Civil Administrative Court dismissed her case, stressing that the documents she submitted contained no evidence that the mall was at fault.
The court also said the plaintiff did not request an investigation into the matter to prove an element of error.
The defendant also contended that the company that insured the woman’s vehicle had agreed to repair the damage done to her vehicle and that she was the one who refused to accept the repair.
