The Abu Dhabi Court of Appeal has overturned a ruling by the Abu Dhabi Court of First Instance ordering a man to return Dh71,000 to his sister.
The man’s sister filed a lawsuit seeking his return of Dhs71,500 of her Dhs71,500 with 12 per cent interest, in addition to the costs and costs of the case and legal fees, claiming that he borrowed the money from her and did not return it, while The brother confirmed that the documents submitted by his sister were forged, and the crime lab backed this up.
The sister claimed that her brother borrowed Dh101,000 from her and gave her the car worth Dh30,000, but did not return the remaining amount despite her claim to him.
The brothers’ lawyers asked for the case to be dismissed because it had been heard before, emphasizing that the complainant’s documents in this case were the same as those proved to be forged in the previous case, based on the forensic laboratory report.
The Court of First Instance ordered the younger brother to return Dh71,000 to the younger sister and to pay the costs and expenses of the case as well as legal fees.
The complaining brother refused to accept the judgment and requested that the case be transferred for investigation to prove that the documents were forged.
The plaintiff had previously filed a civil suit against her brother on the same grounds, but the court dismissed the case at the time after a forensic test report proved the document was a forgery, according to documents, and the ruling became final, the court said.
Therefore, the court overturned the appeal judgment, dismissed the original judgment, and ordered the plaintiff sisters to bear the litigation costs and attorney fees.
