Derek requested that the appeal be retained, hoping that the Supreme Court could review the “earlier decision to reject him as a public defender.”
Derek’s attorney fees were previously paid by the Legal Defense Fund of the Minnesota Police and Peace Officials Association. In view of the results of the trial, funding sources have dried up.
“I was told that their obligation to pay my agency fees ended after I was convicted and sentenced,” Derek wrote in his affidavit.
