UAE Tenancy Law: Can I continue to live in a family-only building after sending my family home? – information

Q: I am a resident of Sharjah and have to send my wife and children home due to an emergency. In the next few months, they must stay in my home country, so I cancelled their visa. I live in a 2BHK apartment in a “family only” building and my contract renewal is coming soon. Is there any way I can continue to stay in the building as a bachelor? I will not sublet an apartment or let other bachelors share it. But I need to keep the apartment because I plan to bring my family back next year.

Reply: According to your inquiry, since you live in an apartment in Sharjah, the Sharjah Law No. 2 of 2007 regulating the relationship between landlords and tenants in the Emirate of Sharjah (Sharjah Tenancy Law) apply.

The Sharjah City Government has notified the public that single persons or single men are not allowed to live in buildings and locations exclusively for family use. Since you live in a building that only allows families to stay, you may need to ask your landlord in writing to renew the lease contract and continue to live alone in the above apartment until you bring your family back to the UAE next year.

In addition, in the letter to the landlord, you may have to promise not to share or sublet the rented apartment with anyone. Depending on your request, your landlord may allow you to continue living in the currently rented apartment.

However, if the tenant allows the rented apartment to be shared or subletted to anyone else without the landlord’s permission, the landlord can evict him. In addition, if the rented apartment is used in violation of public order, the landlord can also evict the tenant.

This is in line with Article 12, paragraph 4, of the Sharjah Lease Law, which states: “The landlord shall not request the eviction of the tenant before the expiration of the lease term three years before the date of the signing of the lease contract, except in the following circumstances:

If the lessee uses the leased house for purposes other than those specified in the lease contract or violates its terms and conditions, or uses it for purposes that violate public order or morality. “

According to the above-mentioned legal provisions, public order may also include an order from the Sharjah City Government that does not allow single men to live in apartments located in designated family areas.

In addition, you can also contact the Sharjah City Government to explain your situation and ask the City Government to allow you to live in the current apartment after renewing the lease contract until your family joins you next year.
