The Abu Dhabi Court of Family and Civil and Administrative Cases has dismissed a lawsuit brought by a man in which he demanded that another be obliged to pay him Dh250,000, including Dh200,000 for a caravan he sold him , and AED 50,000 as compensation for the unpaid value of the caravan.
The complainant filed a lawsuit seeking termination of the caravan sales contract and compensation of AED 50,000, as well as litigation costs. He stated that he verbally agreed to the sale of a moving caravan for Dh200,000 by the respondent, who received the caravan to try it out for a week before impounding it without paying.
The appellant affirmed that he was harmed by not receiving the value of the caravan or even recovering it.
The court ruled that the appellee swore to confirm that it had given the full value of the caravan to the appellant, noting that the WhatsApp messages were considered prima facie evidence that the appellee paid the full price of the caravan, but this was not sufficient.
After the appellee was sworn in, he proved to the court that he did not owe money, so the suit was dismissed and the appellant was ordered to pay fees and expenses.
