Abu Dhabi court orders company to pay sales manager Dh88,000 as compensation

The Abu Dhabi Court of Appeal ordered a company to pay AED 88,000 to a sales manager who worked for it as a labor entitlement, as well as court costs and expenses after the sales manager sued for his dues.

The company stated that it terminated its services to the appellee due to the appellee’s poor job performance and unsuccessful efforts to attract the company’s clients.

The case dates back to an earlier period when the appellant filed a lawsuit seeking AED18,000 from the company he worked for as wages and end-of-service gratuity of AED11,760, unfair compensation in addition to the costs and expenses of the case. 3-month rate dismissal equal to Dhs54,000, warning allowance of Dhs54,000 and legal interest of 12% from date of claim up to full payment. He also asked to hand over proof of experience.

The manager said in the lawsuit that he joined the company on an indefinite employment contract as a sales manager for a fee of Dh18,000 and a base amount of Dh12,600, adding that he had been working until the company arbitrarily terminated his services. No warning and no payment of his dues.

The company’s lawyers confirmed that the appellant was underperforming and had not succeeded in attracting any clients to the company, noting that the company warned him to reduce his salary to Dh15,000 due to the coronavirus pandemic. WhatsApp messages were exchanged between them before warning him to terminate the service with a three-month notice period.

The company’s lawyers also said that the employee had Dh24,000 in company money, a laptop and private keys to his office, but he did not return it, indicating that the appellant had Dh12,000 in end-of-service fees and had spent the finished his vacation and was not entitled to compensation.

Attorneys requested that the case be dismissed, and that the appellant was obliged to pay the costs of the case and attorney’s fees.
