Abu Dhabi court rejects woman’s request for Dh150,000 from ex-husband

The Abu Dhabi Court of Appeal upheld the ruling of the Abu Dhabi Court of Family, Civil and Administrative Cases, which dismissed a lawsuit brought by a woman obliging her ex-husband to pay her AED 150,000 worth AED 150,000 She gave him a loan during her marriage.

The court noted that the case documents did not contain any evidence of debt.

Details of the case date back to an earlier time when the appellant filed a lawsuit demanding that her ex-husband be obliged to pay her Dh150,000 plus 12% of his legal interest from the date of the claim, as well as fees, expenses and attorney’s fees .

The appellant claims that during her marriage to the respondent, she lent him Dh150,000, of which Dh100,000 was by bank transfer, and two cheques, the first of which was Dh40,000 , the second is 10,000 dirhams.

The appellant affirmed that she requested the appellee to refund the payment, but the appellant delayed and refused to repay.

She attached the bank transfer receipt, two legally translated checks and the identity of the respondent to her claim.

The appellant stated that the money transferred to his account was a repayment of a debt he owed to the appellant. He attached a receipt for the transfer of Dh100,000 from his account to the appellant’s account before she transferred the same amount into his account.

The court of first instance dismissed the case and ordered the appellant to pay the costs and expenses of the case.

The appellant appealed the ruling, but the court dismissed her appeal.
