Abu Dhabi man duped into buying AED80,000 watch on Snapchat

The Abu Dhabi Family, Civil and Administrative Cases Court ordered a man to pay Dh80,000 and Dh5,000 in compensation.

The case dates back to an earlier time, when a man contacted another person to buy a valuable watch from him through the “Snapchat” application. After negotiating the price, the first sum was transferred to the watch owner Dhs80,000. The latter, on the other hand, does not deliver the watch and delays returns.

The man sued the owner of the watch in court, asking him to return Dhs80,000 and his legal interest of 9% from the date of filing the suit until full payment, in addition to Dhs20,000 in compensation. material and moral damages, litigation costs and expenses, and attorney fees.

The appellant stated that he contacted the respondent through the “Snap chat” application to buy a watch worth Dh80,000 and transferred the money to the respondent’s bank account in July 2022 on the premise that he would receive it in the middle of the month. to the watch. -August, but the respondent did not deliver, and there was another delay in asking for a refund.

The court said that the appellee had not fulfilled his obligation to hand over the watch to the appellant pursuant to the conversation between the two parties through the “Snapchat” application, noting that the appellee confessed at the settlement center that he had received Dhs80,000 for the watch and its accessories, he Ready to repay in full within 10 days.

The court stated that the appellant suffered losses due to the confiscation of his money and delay in payment by the appellee, and decided to compensate him Dhs5,000 for all resulting losses.

The court ruled to cancel the oral sales contract between the two parties, and ordered the respondent to return Dhs80,000 to the plaintiff, and compensate the plaintiff for material and moral losses of Dhs5,000, as well as the costs and expenses of the case. and attorney fees.
