Italian opera singer Andrea Bocelli is suing a charter company that specializes in luxury jets, claiming it provided him with an older, noisier plane than agreed on during his US tour last year .
The lawsuit, filed in New Hampshire federal court by 64-year-old Bocelli in September, also alleges that Seabrook’s private jet service company violated the terms of its contract when the crew on a flight announced that Bocelli and his team had There should be bumps. Bocelli, a tenor who has performed around the world, is seeking refunds of triple the $569,800 (£513,400) he paid for 15 flights, the amount he paid for alternative flight arrangements, lawyers’ fees and damages .
Bocelli’s representatives contracted the company to fly him around the United States during his tour last November and December, the statement said.
Specifications include acceptable models and years of manufacture that “ideally should not be ‘more than’ four years”, as well as requirements for in-flight service.
“He was also not a very keen flyer because he was afraid of flying and would experience anxiety related to safety issues during air travel,” the lawsuit filed by attorney Michelle Kenny says.
“In particular, he was sensitive to the high noise in flight from older aircraft, which made him even more anxious.”
The statement said that every time Bocelli leased a jet, commanders were instructed not to make any announcements about weather conditions on board, nor to mention airborne turbulence, “all to avoid giving Mr Bocelli excessive anxiety.”
It said Professional Jet Services agreed to the requests, including the use of the Falcon 2000LX for short-haul flights within the United States and a different aircraft for transatlantic flights.
But the final “statement or work” precludes the proposal’s provisions identifying specific aircraft and, in small print, “declares, among other things, a type of aircraft that has not been agreed upon by the parties – the Falcon 2000, not the Falcon 2000LX.”
On a Dec. 2 flight from Santa Ana, Calif., to Cleveland, the company offered a 1996-built Falcon 2000.
The flight attendants announced that they should have a bumpy ride before landing.
Traveling on the old plane and hearing the announcement “made him anxious and worried for his safety during the last 20 minutes of the flight”, the claim said.
It said the company apologised for the wrong aircraft and crew mistakes, but a company representative said they were unable to find an acceptable aircraft for the last five tour dates.
The claim does not say whether the company provided the correct aircraft for any part of the trip.
The company then cancelled the last-dated flight and offered no refund, forcing Bocelli to charter a new flight with another company, costing him more than $300,000 (£270,000), the claim alleges.
