How skilled workers, self-employed and investors can apply for a UAE green visa

From September 5, company directors, executives, engineers, professionals and technicians in the fields of science, technology and humanity will be classified as Emirati workers and can apply for a five-year green visa.

The green visa will be offered to people with a bachelor’s degree earning 15,000 dirhams ($4,084) or more a month, as part of a sweeping reform to attract new talent to the UAE and encourage residents to stay longer.

This visa provides five-year residency without the need for an employer or sponsor, and allows the holder to bring first-degree relatives to the country during their stay.

Investors and business partners of commercial enterprises, freelancers and highly skilled workers are eligible for green visas.

The UAE Cabinet has approved green visas under Decision No. 65 of 2022.

Foreigners who want to apply for a green visa can apply for a 60-day entry work permit to come to the UAE and complete the application upon arrival.

Who can apply for a green visa?

UAE authorities have identified three categories of people who can apply for a green visa.

Investors/business partners with commercial licenses, freelancers/self-employed and highly skilled workers.

The fees associated with applying for these three types of green visas have not been announced.

Skilled Worker Green Visa

Ministry of Human Resources and Emirates (MoHRE) nine different job skill levelin line with the International Standard Occupational Classification.

To apply for the category of skilled workers, the applicants should be classified into one, two and three levels.

Workers should have a valid work contract in the UAE with a salary of AED 15,000 and a bachelor’s degree in certain technical fields including science, law, education, culture and social sciences.

Green Visas for Investors and Business Partners

Investor Green Visas are issued to those who establish or engage in business activities. It replaces the residence that was previously valid for two years.

The Federal Identity, Citizenship, Customs and Port Security Administration can grant a green visa after obtaining investment approval from the relevant local authority and proof of investment from the investor or business person.

If the investor holds more than one license, the total invested capital will be calculated.

Green visa for freelancers/self-employed

A freelancer or self-employed person can obtain a five-year work permit without a sponsor or contract, even if the person is abroad.

To be eligible, a freelancer should have at least a bachelor’s degree and either provide an annual income of not less than Dh360,000 for the past two years or prove their solvency over a five-year period.

They should also have a freelance/self-employment license issued by the Ministry of Human Resources and Emirates.

Can a green visa holder sponsor a sponsor?

Green visa holders can sponsor first-degree relatives for five years of residency.

First-degree relatives (spouse, son, daughter and parents) have the same length of stay as green visa holders.

Previously, this was usually allowed for two to three years.

Dependents can receive a 30-day grace period from the date their visa expires or is cancelled to obtain a new residence permit. If green visa holders fail to renew or cancel their dependents’ visas, dependents may be required to pay overstay penalties.

According to the UAE Immigration Department’s fine system, the fine after the grace period ends is AED 125 for the first day and AED 25 for each day thereafter.

The fine will be Dh50 per day if the dependant is overstaying for more than six months and Dh100 per day after one year of overstay.

Green visas may become invalid if the holder stays outside the UAE for more than 180 days.
