Husband threatens wife with Dh215,000 check for 5 years in Abu Dhabi to force her to accept divorce

The Abu Dhabi Court of First Instance has acquitted a woman over a Dh215,000 check and ordered her ex-husband to return the value of the check to her and cancel it.

The woman filed the lawsuit alleging she sent a check to her ex-husband five years ago to buy her a piece of land, but he didn’t do so and claimed he tore up the check.

She added that after they argued, he threatened her with a check to accept a divorce.

In her lawsuit, the appellant seeks to void the payment order for the check and that her ex-husband be obliged to return the money to her, showing that she owes him nothing.

She also demanded that he be obligated to pay legal costs and attorneys’ fees.

The complainant explained that she gave her husband a check of Dhs215,000 to buy a piece of land in an Arab country for her during their marriage, but he convinced her to drop the idea and started a new project for him, so she again Gave him a check for Dhs70,000 on the condition that he cancel the first check, which he did not cancel.

“I filed a criminal case against him and he was sentenced for falsifying documents in my name and then I filed an alimony suit against him which resulted in him owing me money which he didn’t pay back so he threatened me with the first check It goes back five years and an executory judgment was issued for him,” she said.

The plaintiff provided evidence that the check was written for the purchase of property in the Arab country, the court said, and she also produced a dated assignment contract addressed to the respondent and a petition filed with the public prosecution alleging He broke his promise.

“Based on the respondent’s WhatsApp chats, he threatened the complainant to show the check if she did not accept the divorce,” the court noted, confirming that it had been proven that Dhs70,000 had been withdrawn from the complainant’s bank account, proving that Her assertion, moreover, does not appear to have been contested by appellee.

The court then annulled the order to scatter the Dhs215,000 check and ordered the appellee to return the amount to the appellant.

The court also acquitted her of owing him the value of the check and ordered him to pay the costs and expenses of the case, as well as attorneys’ fees.
