A mother filed a lawsuit at the Abu Dhabi Family and Civil and Administrative Claims Court against her daughter, claiming that she must pay AED 85,000, while being obliged to pay expenses and fees, as well as lawful interest of 12% from the date of filing the lawsuit costs until payment is made and obligates her to pay attorneys’ fees.
The mother said in the lawsuit that the daughter used her bank card and withdrew Dh85,000 from it before leaving the house, attaching a photo of the account details.
The court said that under the law of evidence, plaintiffs must prove their claims, defendants have the right to deny them, the burden of proof to assert claims is on defenders, and court inaction is obliged to conduct investigations not requested by litigants.
The court affirmed that there was nothing in the case file to validate the mother’s claim and did not call for an investigation to substantiate her claim.
On the other hand, the daughter denied that her mother’s claim was valid, so she ruled that the lawsuit should not be accepted and asked the mother to bear the relevant expenses.
