Parents blame hospital for paralyzed newborn baby, court rejects claim for compensation

The Abu Dhabi Court of Family and Civil and Administrative Cases dismissed a lawsuit filed by the parents of a child claiming that the hospital was obliged to pay them Dh100,000 as interim compensation after the child’s mother gave birth at the hospital, but the newborn was paralyzed.

The appellant filed a lawsuit, seeking compensation and entrusting the medical board to explain the doctor’s error, and asking the hospital to pay the litigation costs and attorney’s fees.

My mother said to go to the hospital for a natural delivery, agreed to have a caesarean section, and then transferred to the delivery room, but the doctor didn’t come. She identified a doctor’s error as causing her injuries and her baby’s paralysis, and was later pushed to avoid responsibility when she took her newborn to the hospital.

She also confirmed that she asked the hospital for a caesarean section and promised to pay all the expenses, but the attending doctor gave birth smoothly, resulting in paralysis of the newborn.

The two complainants confirmed they had taken their son to various hospitals and had exhausted their insurance coverage for him.

The court said the child’s mother lodged a complaint against the hospital with the medical liability committee based on a report that did not show medical error at the hospital.

It added that the committee’s report remained valid in its original form before the court dismissed the suit and ordered the complainant to pay fees, expenses and attorneys’ fees.
