According to reports, the Department of Justice filed an urgent motion on Tuesday night to prevent the state of Texas from enforcing their newly passed abortion law, SB8.
This was a week after the state was prosecuted for abortion laws.
The motion stated that “this attempt to protect an obviously unconstitutional law from review is untenable,” the motion reads. “The United States seeks a temporary restraining order or a preliminary injunction prohibiting the implementation of SB 8. This remedy is necessary to protect the constitutional rights of Texas women and the sovereign interests of the United States to ensure that its states respect the provisions of the national contract.”
When talking about the responsibility of the United States, the motion continued: “The United States has the power and responsibility to ensure that Texas cannot be immune from judicial review for its violation of the Constitution and to protect important federal interests that SB 8 damage. Therefore, this court SB 8 should be prohibited.”
As mentioned earlier, the Department of Justice also sued Texas. The lawsuit requires the judge to declare the law invalid.
“According to the Supreme Court’s long-standing jurisprudence, the bill is clearly unconstitutional,” Attorney General Merrick Garland said at a press conference announcing the lawsuit. Fox 11 Los Angeles Also reported.
