As the Texas clinic resumed providing abortion services, the New Orleans court ruled.
The U.S. Federal Court of Appeals ruled on Friday that Texas can reinstate the ban on most abortions, and another court suspended the ban two days later.
The New Orleans court’s ruling came as a Texas clinic resumed providing abortion services for the first time since it went into effect in September — banning abortions for more than six weeks.
The Fifth Circuit Panel of three judges asked the Department of Justice to respond to the Texas documents by Tuesday.
Representatives of the Ministry of Justice did not immediately respond to a request for comment.
Texas Attorney General Ken Paxton earlier Friday appealed the decision of U.S. District Judge Robert Pittman in Austin to prevent the state from enforcing a Republican-backed law that prohibits women from having sex after six weeks of pregnancy. Abortion, while lawsuits for its legality continue.
The case is part of a fierce legal battle over abortion in the United States, and many states have tried to impose restrictions on the procedure.
After the Supreme Court of the United States allowed it to take effect, President Joe Biden’s administration challenged Texas law.
Biden’s Department of Justice sued Texas on September 9 and sought a temporary injunction, arguing at the October 1 hearing that the measure violated the U.S. Constitution.
The U.S. Supreme Court voted 5 to 4 on September 1 to allow the law to take effect under the leadership of conservative judges.
At six weeks of pregnancy, many women don’t even know that they are pregnant. The law does not make any exceptions to pregnancy caused by rape or incest.
Texas law allows citizens to enforce the ban, and if they succeed in prosecuting anyone who helps provide abortions after detecting fetal heart activity, they will receive at least $10,000 in rewards. Critics of the law say the clause allows people to act as anti-abortion bounty hunters.
The Ministry of Justice argued that the law prevented women from exercising their constitutional right to terminate pregnancy, which the Supreme Court recognized in its decision in Roe v. Wade.
