question: I am looking to make some investments in Dubai. Can expats or foreigners own land in Dubai? Can you explain the laws on foreign land ownership?

Reply: Based on your enquiry, when you intend to invest in Dubai by purchasing land parcels, please comply with the provisions of Law No. 7 of 2006 on Real Estate Registration in the Emirate of Dubai (“Dubai Real Estate Registration Law”) and Regulation No. 20. No. 3 of 2006 “Determination of Areas in the Emirate of Dubai Owned by Non-UAE Nationals” and its subsequent amendments (Dubai Law in relation to areas where non-UAE nationals own immovable property) apply.

It is worth noting that expats who are not UAE nationals or nationals of any GCC country may own plots or properties in certain areas identified by His Highness the Ruler of Dubai. This is in line with Section 4 of the Dubai Real Property Registration Act, which states: “The right to own immovable property in the emirate is limited to UAE nationals, nationals of GCC countries, companies wholly owned by these nationals, and public joint stock companies. With the approval of the Ruler, Non-UAE nationals have the following rights in the relevant areas as determined by the ruler:

One.Freehold title to immovable property with no time limit; and

b. The right to use or lease real property for up to 99 years. “

In addition, from time to time His Highness the Ruler of Dubai has promulgated Dubai Laws in relation to areas in which non-UAE nationals own immovable property, identifying and delimiting specific areas in the Emirate of Dubai where non-UAE nationals shall (i) own the freehold of immovable property; (ii) 99 Years of the right to use the property (right to build) or lease.

According to the above-mentioned laws, as an expat, you have the right to own land/property in certain areas of Dubai.
