An Abu Dhabi motorist who was permanently disabled after being seriously injured in a serious traffic accident has been awarded Dh70,000 in compensation.
The Abu Dhabi Civil Court of First Instance ordered the company that insured the car involved in the accident to pay the victim Dh60,000 for physical damage and Dh10,000 for moral damage.
According to official court documents, the man filed a lawsuit against the insurance company, demanding that the insurance company pay him Dh100,000 for his physical, mental and material damage.
He said in the lawsuit that he was driving on a road in Abu Dhabi when another vehicle hit his car. The Department of Transportation blamed the accident on the reckless behavior of the second driver.
The plaintiff said he was seriously injured and was taken to hospital for weeks.
A medical report by a court-appointed forensic doctor stated that the complainant had a permanent disability of 5 per cent of his right lower extremity and 25 per cent of his left lower extremity.
The traffic court had earlier convicted the driver of the second vehicle for causing the accident by recklessness and fined him Dh10,000. It was also determined that the insurance company that insured the second vehicle was responsible for paying the damages caused by the accident.
The defendant then filed a civil lawsuit against the insurance company, demanding compensation for the loss.
After hearing the opinions of all parties, the judge of the civil court issued a ruling ordering the insurance company to pay Dh70,000 to the plaintiff as damages.
The insurance company will also pay the plaintiff’s legal fees.
