UAE Golden Visa: Private sector employees in Dubai must hold work permits and insurance-News

Question: I am an employee of a company in Dubai and was told that I am eligible for a golden visa. Do I need a labor card to continue working in my company? Will the company continue to provide me with health insurance?

Reply: Based on your inquiry, we assume that you are employed by a mainland company in Dubai. Therefore, the provisions of Federal Law No. 8 of 1980 (Employment Law) and Law No. 11 of 2013 concerning health insurance in the Emirate of Dubai (Dubai Health Insurance Law) shall apply.

The UAE Cabinet Resolution No. 56 of 2018 allows foreigners to obtain long-term residence visas (golden visas) in the UAE. We assume that you are eligible to obtain it based on your occupation. It is worth noting that the Ministry of Human Resources and the Emirates (MOHRE) issued a statement on July 1, 2021, confirming that private sector employees who are eligible for golden visas need to hold a work permit. The provisions of the Employment Law apply to such employees.

Employees holding golden visas need to obtain a work permit from MOHRE in order to be employed by private companies or entities. Employers are responsible for providing health insurance for their employees in Dubai. This is in line with Article 10 of the Dubai Health Insurance Law, which states: “Employers are obliged to do the following:

1. Provide employees with health insurance in accordance with applicable health insurance policies.

2. To bear the costs of such health insurance, rather than let the beneficiaries bear such costs.

3. Verify that the employee’s health insurance is valid during the working period.

4. To bear the medical and health services and emergency medical intervention costs for employees who do not participate in medical insurance as stipulated in this law.

5. Give employees a health insurance card.

6. Provide the health insurance policy when the employee’s residence permit is issued or renewed.

7. Other obligations of the Bureau in accordance with the resolutions.

In addition, Article 96 of the Employment Law stipulates: “Employers must provide employees with medical services in accordance with the standards established by the Ministry of Health in conjunction with the Ministry of Health.”

Therefore, according to these regulations, your employer must provide you with health insurance during your employment. Article 23 of the Dubai Health Insurance Law stipulates that if an employer fails to provide health insurance, the relevant authority or the Dubai Health Authority (DHA) may impose a fine of 500 to 150,000 dirhams. If the employer repeatedly violates this law, the fine may be as high as AED 500,000.
