UAE Unemployment Insurance: 10 criteria employees must meet to be eligible for compensation – News

While unemployment can be a stressful time for anyone, UAE citizens and expats will now be eligible for unemployment insurance under the new involuntary unemployment scheme.

The mandatory scheme, designed to protect workers from the risk of unemployment, will come into force in early 2023 and will apply to employees of all nationalities in the public and private sectors.

However, according to the official Involuntary Unemployment Program website, the insured must meet the following conditions in order to receive compensation:

eligibility criteria

  • The insured must have at least 12 consecutive months of subscription to the plan
  • Subscription must be continuous for 3 months without interruption
  • The insured must undertake to pay all premiums due on time
  • The insured must certify that unemployment was not due to resignation
  • In addition to any applicable legislation, the insured may not be dismissed for disciplinary reasons under the Labor Relations Act and the Human Resources Act of the Commonwealth Government
  • The insured must file a claim within 30 days of the date of loss of employment relationship, or resolve labor complaints with judicial authorities
  • Insured workers should not have existing complaints related to absences
  • Insureds are not entitled to compensation if their claims involve fraud or deceit, or if the agency they work for is fictitious
  • Unemployment should not be the result of non-peaceful strikes or lockouts, whether or not they cause harm
  • The insured must be legally present in the UAE

In addition, the program provides that unemployment should not be due to one of the following reasons:

  • Due to declared or undeclared war, insurrection, rebellion, armed insurrection, revolution, military or usurped force, invasion, act of foreign enemy, hostilities, civil war or civil strife
  • radioactive, toxic, explosive or other hazardous effects of any explosive nuclear device or components of such device due to discharge of pollutants, nuclear incident, or
  • Direct or indirect results of biological or chemical contamination caused by or conducive to terrorism
  • Confiscation or nationalization of his employer’s facilities, or confiscation of his money resulting in his bankruptcy as a result of direct action by the Government of the United Arab Emirates
  • According to the United Arab Emirates Civil Transactions Law No. (5) of 1985, due to the occurrence of force majeure.
