question: Can you explain the latest regulations for hiring maids in the UAE? My wife and I need to find a full time maid to take care of our children. We would love to hire a maid from here or bring back a maid from our home country. But we don’t want to accidentally break any rules. please help.

answer: Based on your query, it is assumed that you are a resident of Dubai and employed by an employer in the UAE. Accordingly, the provisions of Federal Decree No. 9 of 2022 on Domestic Workers and Cabinet Resolution No. 106 of 2022 on the Implementation Regulations of Federal Decree No. 9 of 2022 on Domestic Workers apply.

According to Schedule 1 of Cabinet Resolution No. 106 of 2022 on the Domestic Workers Law, there are various names for domestic workers recruited in the UAE. Individuals living with their spouses can sponsor a nanny to care for their children based on the salary of the individual sponsoring the nanny, the number of bedrooms in the apartment or villa where he or she lives. In addition, to obtain an entry permit for a nanny in the UAE initially, the following documents are required.

Nanny ID:

  • nanny color photo
  • her passport
  • her tourist visa if she is in the UAE or on UAE visa cancellation documents; and
  • NOC from the embassy if the nanny is from the same nationality as the sponsor

Sponsor file:

  • passport
  • Salary certificate (Arabic)
  • Copy of labor contract
  • Copy of Ejari if the guarantor is a resident of Dubai
  • Legal and certified copy of marriage certificate legally translated into Arabic
  • IBAN number and three (3) month bank statements
  • Photocopy of the original UAE National ID
  • Copy of spouse’s passport and UAE residence visa

Once an entry permit has been obtained from Dubai’s General Directorate of Residency and Foreigners Affairs (GDRFA), sponsors and nannies can enter into an employment contract with the Ministry of Human Resources and Emiratisation (MoHRE). Thereafter, once the nanny’s work permit is approved by MoHRE, she needs to undergo a medical examination by the Dubai Health Authority and apply for a UAE resident identity card through Federal Identity, Citizenship, Customs and Port Security.

Sponsors for nanny are required to follow the guidelines and regulations of the UAE Domestic Worker Law when hiring a nanny at their residence. It may include, but is not limited to, providing the sitter with the facilities to perform her duties, assigning appropriate housing, providing food and tools, clothing needed to perform her duties, timely payment of compensation, incurring costs related to health insurance, being respectful of the sitter, and that the sitter should be treated as Allowed to keep her official papers. This is in line with Article 11 of the UAE Domestic Workers Law, which sets out the obligations of the employer/sponsor towards the nanny.

Also, Article 7 of Cabinet Resolution No. 106 of 2022 on the Domestic Workers Act stipulates that employers/sponsors shall not hire sitters to work for no more than 12 hours after 8 consecutive hours per day without rest. Article 8 of Cabinet Resolution No. 106 of 2022 on the Domestic Workers Act states that employers/sponsors are required to grant weekly leave to nanny.

Based on the above regulations and requirements, if you meet the relevant requirements, you may consider hiring a nanny to take care of your children. However, you may also consider hiring a nanny in the UAE through the UAE-accredited domestic recruitment agencies mentioned in Articles 4 and 5 of the UAE Domestic Workers Law.
