The Abu Dhabi Court of Appeal has ordered a company to pay Dh150,000 to a worker for damages caused by the amputation of his hand after he was injured while working in a meat grinder. .
The details date back to earlier, when the worker filed a lawsuit claiming that the company was obliged to pay him Dh200,000 for the damages he had suffered and was obliged to pay the following costs and expenses: litigation and legal fees.
The plaintiff explained that while working for the company, his right hand was caught in a meat grinder, resulting in the amputation of the palm of his right hand.
He stressed that this was due to the failure of the company to provide the proper safety and precautions necessary to protect him from dangers at work.
He also said that the court had previously found the company guilty and fined it Dh10,000 and was obliged to pay him Dh100,000 in wrongdoing damages.
In the Court of First Instance, the worker requested the participation of new litigants, including the manager of the company and 3 other companies, and a ruling that they were jointly obliged to pay him Dh1 million in material and moral compensation for his loss. incurred, in addition to the statutory interest of 12% from the date of filing the suit until full payment.
He also asked for his referral to a forensic examiner to determine the extent of his disability and its impact on his future.
The Abu Dhabi Family and Civil and Administrative Cases Court (Level 1) ordered the company to pay the worker AED 100,000 for material and moral damages suffered, as well as legal costs and expenses.
Both parties appealed the judgment and the worker confirmed that the compensation was not commensurate with the extent of the damage he had suffered, as he had lost his right hand, lost his job with the company, and the opportunity to find another job in the future, especially since he worked with his own hands , without any other occupation or trade.
He added that he supported a family of his mother and son who had no other breadwinners.
The court found that the company’s negligence caused the damage and should be compensated, indicating that the forensic medical report confirmed the complete amputation of the right hand, resulting in a permanent disability of 100% of the original ability of the right hand.
The court then accepted the worker’s appeal, dismissed the company’s appeal and ordered the company to pay him Dh150,000 in addition to the costs and expenses of the two appeals.
