Prosecutors are asking for a 70-month sentence for Brown, who they say rushed to the front of a makeshift police line and used a stolen can of pepper spray that Schwartz handed him at officers.
Brown’s attorney, Samuel C. Moore, was sentenced to 40 months in prison, according to court documents.
Moore said the act involved “less than 10 minutes of Mr. Brown’s life” and that the alleged pepper spray “did not come into contact with any specific victim.”
