The bill seeks to curtail the powers of the Chief Justice of Pakistan (CJP) – including the formation of suo motu and benches.

The president has sent the bill back to Congress for reconsideration under Article 75 of the Constitution, saying the bill is ostensibly beyond the purview of Congress and can be attacked as legislation for people of color, Geo News reported.

According to a circular issued by the Congress Secretariat, “In order to exercise the powers conferred by the Ritual Clause 4 of the Parliament (Joint Meetings) Rules 1973, the Honorable Speaker is pleased to call a joint meeting on Monday, April 10, 2023 at 4 pm and Not 2pm”

Earlier, a joint parliamentary session was scheduled for April 10 at 2 p.m., Geo News reported.

If the Supreme Court (Practice and Procedure) Bill 2023 is passed by a majority vote in a joint session of Parliament, it will again be referred to the President for assent. If the President does not nod within 10 days, it is considered passed.

The Legislative Procedures said, “If the President submits a bill to Parliament, the bill will be considered in joint session and if passed by a majority, it will be deemed passed by both houses. Once again sent to the President, it shall be given within 10 days. approval, otherwise consent shall be deemed to have been given.”

A day earlier, Prime Minister Shehbaz Sharif had sharply condemned the president for returning the bill to the Supreme Court without signature, calling him a Pakistani Justice Movement (PTI) operative, Geo News reported.

“It is most unfortunate that President Alvi has rolled back a Supreme Court Bill that was duly passed by Parliament,” the Prime Minister said in a forceful tweet.

According to Geo News, the prime minister tweeted that the president had degraded his office through his actions as he was following the orders of the head of PTI instead of fulfilling his constitutional duty.

He added: “By his actions, he has demeaned the august office because he is a PTI staff member who is more grateful to Imran Niazi than the constitution and requirements of his office.” (Ani)
