Islamabad [Pakistan]24th August (ANI): The legal team of Pakistan Tehreek-e-Insaf (PTI) leader Shahbaz Gill has decided to file a complaint with the Supreme Court against the Pakistani government for “custodial torture”.

According to the Express Tribune, the legal team will also challenge the Islamabad High Court (IHC)’s two-day remand order against Gill under Article 185(3) of the Constitution.

Gill’s lawyer, Chaudhry Faisal Hussain, told the Express Tribune on Tuesday that “custodial torture” has public importance because it is also used against journalists.

“The matter will be brought to the Supreme Court on behalf of Gill, who is currently in police custody,” Faisal Hussain said.

In addition, Acting IHC Chief Justice Amir Farooq said in a written order that when the matter was referred to the Islamabad police chief for a preliminary investigation, the police denied the torture allegations, the Express Tribune reported.

“The register/records of Adiyala, Central Prison do mention certain bruises and other marks on the petitioner’s body while he was being held. According to Article 20 of the Pakistan Prison Supervision and Management Rules, when a prisoner suffers from the marks on his body Sent to prison after being detained by police, he will be examined by medical staff immediately,” it said.

“It also stipulates that if an examination reveals unexplained injuries not recorded in the forensic report accompanying the prisoner, it should be reported immediately to the sitting judge and the head of the prosecution service and the superintendent,” the order added.

The written order also explained that remand should not be refused on the grounds of speculation, adding that remand should be based on recorded material, including police diaries.

Following his transfer from PIMS, Shahbaz Gill was handed over to Islamabad police by Islamabad courts for a two-day physical remand.The court reserved the verdict after hearing arguments and then directed police to bring Gill to testify on August 24.

Gill was arrested for colluding with a private Pakistani TV news channel for anti-state propaganda. He was arrested for speaking out against state institutions and inciting people to rebel, police said.

Pakistani publications claimed the PTI leader had tried to incite hatred among the Pakistani army while speaking on ARY News the previous day, which has been restricted in some parts of the country.

Notably, the regulatory watchdog PEMRA claims the ARY news channel is broadcasting “false, hateful and inflammatory” content based on “absolutely false information that constitutes a clear and current threat to national security by inciting insurgency within the armed forces” .

In the Pakistani government’s crackdown on “anti-state propaganda” by private television broadcaster ARY News, the network’s founder and chief executive Salman Iqbal and two news anchors have been charged with sedition.

On August 9, Gill was arrested by police after making controversial remarks about the Pakistani army on television that were deemed “highly hateful and inflammatory” by the country’s media authorities. Imran’s close aide has been arrested on suspicion of colluding with a private TV news channel for anti-state propaganda.

Notably, Pakistani regulator PEMRA has claimed that the ARY news channel is broadcasting “false, hateful and inflammatory” content based on “absolutely false information that constitutes a clear and current threat to national security by inciting rebellion within the armed forces” . (ANI)
