An Abu Dhabi resident has filed a lawsuit at the Abu Dhabi Court of Family and Civil Administrative Claims to order his brother who has sheltered him for 20 years to leave his home.
The Arab man said in the lawsuit that his brother refused to obey his orders despite his long-term shelter.
He said he had allowed the defendant to temporarily live in a separate wing of his home because of his financial situation, but he never left.
The complainant attributes his claim to the fact that he needs part of his brother’s house for his sons, who are now grown up and need to live separately.
The Court of First Instance earlier relied on the evidence that the complainant and his wife jointly owned the house and the defendant’s admission of staying in his brother’s house for more than 20 years.
The defendant challenged the decision of the Court of Appeal, stressing that the First Court had no jurisdiction to hear his case.
The man also said he lent a large sum of money to his brother’s wife, but he didn’t pay it back, and he stayed at home to exchange money.
His lawyers also argued that there was an error in the application of the law because the property belonged to the defendant and his wife, who each owned 50 per cent, but only the man had lodged a complaint against his client.
After hearing from all parties, the appeals court judge decided to dismiss the case and ordered the plaintiff to pay his brother’s legal costs.
