Investigation not over yet: CBI files FIR 2 years after UAE police close Kerala man’s death

Kerala High Court Judge Ziyad Rahman AA said in an order dated October 14: “As the incident (the death) … occurred in Abu Dhabi, the State Police was unable to conduct a proper investigation. Therefore, she( The victim’s mother) sought an order to refer the investigation to the CBI and this writ petition was filed under the circumstances,” he said.

The judge said: “I think this is a matter of serious investigation and the truth must be found out. As the prosecutor rightly pointed out, since the incident took place in Abu Dhabi, coordination with the foreign agency that originally investigated the matter was absolutely necessary. The competent authority to conduct such an investigation can only be the CBI. In this case, this writ petition is allowed and directs the CBI to conduct an investigation and conduct an effective investigation.”

For Kerala police, who were investigating the case earlier, an unexpected breach came from a pen drive containing purported information about another murder and a common suspicious link: Shaibin Ashraf .

Police later found that Shaba Sharif, a 60-year-old mini-therapist from Mysore, Karnataka, known locally for treating hemorrhoids, was kidnapped from his home in 2019 and held in Malaysia, Kerala. In the complaint filed in the FIR, Harifa said Harris married Nasleena in 2010 and co-founded a business consultancy firm in Abu Dhabi. Soon, they became friends with Xie Bin, who in time was “jealous” of Harris’ business growth.

According to the complainant, Harris divorced Nasrina after learning that she was having an affair with Xie Bin. “On March 1, 2018, Harris was attacked at the Kozhikode Medical College in Kerala and later conspired with Nasleena and her father to kill Harris and rob him of his business. In his order, Judge Ziyad Rahman noted that Naushad, who provided the police with the pen drive, “disclosed it through a video uploaded to YouTube, reported by one of the Malayalam-language news channels, which mentioned their murder. The petitioner’s son and woman followed Chai Bin’s instructions. According to (the) information, the petitioner filed a complaint and the Nilambur Police Station (according to Harifa’s complaint) registered the FIR. She was aggrieved that even though the case was filed, it was not carried out Effective investigation…”
