Abu Dhabi woman pays ex-husband Dh10,000 for insulting emails

The Abu Dhabi Court of Appeal has upheld a trial court ruling ordering a woman to pay her ex-husband Dh10,000 for damages she caused him after insulting him in an email.

The details can be traced back to earlier, when the complainant filed a lawsuit, demanding that the ex-wife must pay him Dh100,000 in material and spiritual compensation in addition to the litigation costs.

The complainant stated that the respondent was his wife and they had two sons. She allegedly traveled with one of them and returned a year and a half later, after which she abused him via email.

The Abu Dhabi Family, Civil and Administrative Cases Court ordered the respondent to pay the plaintiff Dh10,000 in addition to costs and expenses, so the parties appealed the ruling.

On appeal, the complainant affirmed that the amount of compensation was insignificant and did not correspond to the damages he had suffered as a result of the insult to his reputation, religious beliefs and his social and working environment.

In her appeal, the respondent affirmed that her ex-husband had submitted the first instance judgment and that she denied the insult.

She also said the writing style of the message turned out to be false, stressing that she was prepared to swear in denial.

She asked for the judgment to be quashed, dismissing the case for lack of validity and evidence. She also asked for a reduction in the amount of compensation on the grounds of unemployment.

The court confirmed that the insulting message contained contempt for the appellant, showing that the insult had hurt him. The court also stated that the amount of compensation was appropriate, and then rejected the two appeals and upheld the judgment of the court of first instance.
