The buyer had asked the seller if he could use the vehicle while it was still registered in his name
A motorist bought a car from an Abu Dhabi resident for Dh7,000 and paid Dh80,000 in traffic fines while the car was still registered to the seller.
The seller filed a lawsuit against the defendant at the Abu Dhabi Family and Civil Administrative Court for payment of traffic fines he committed using the car sold to him, official court documents said.
The plaintiff said he sold the car to the defendant for Dh7,000. However, the defendant then asked if he could use the casr while it was still registered in the plaintiff’s name. This way he can raise funds to transfer ownership of the car.
The man said he accumulated Dh80,000 in traffic fines when the accused used the car and then refused to pay the amount.
This prompted him to drag the defendant to court so he could be forced to pay the fines committed and have the car transferred to his name.
Article 32 of the UAE Traffic Law stipulates that any disposition to transfer ownership of a motor vehicle shall be notified to the licensing authority within fourteen days by both parties to the disposition. The original driver’s license holder shall be liable for the obligations arising from the use of the vehicle until the transfer of the driver’s license to the other party is completed.
The court ordered a panel to look into the matter. Subsequent investigations revealed that the accused had settled traffic fines.
The judge then dismissed the case. The plaintiffs were told to pay their own legal fees.
