Due to recent reforms to the US government’s investment immigration program, the EB-5 Immigrant Investor Program, residents of the UAE and neighboring GCC countries can benefit from priority processing of their US EB-5 Golden Visa. The introduction of a new reserved visa category under the EB-5 program has been particularly effective for Indian and Chinese nationals, who have traditionally had to wait longer due to the high volume of applications from these countries.

Families living in the area can obtain US green cards by investing in qualifying projects. A green card brings numerous benefits to families. The main benefit is that it allows its holder to live and work permanently in the U.S. and provides a stable and secure path to U.S. citizenship.

What is the US Golden Visa?

The EB-5 program was implemented by the US Congress in 1990 as a way to boost the US economy by injecting foreign capital and creating jobs for Americans. The program requires an investment of $800,000 in eligible government pre-approved real estate projects. Compared to other US immigration pathways, the EB-5 program is one of the fastest and easiest ways to obtain a green card. In exchange for an $800,000 investment, a family including a spouse and children under the age of 21 will receive US residency and green cards. After about five years, the capital investment is returned to the family.

The program has been successful since its inception because, on the one hand, it provided an alternative means of financing development projects in the United States, and on the other hand, it provided immigrants with a faster path to enter the United States. Developers are keen to use EB-5 capital given the low interest rates compared to traditional forms of financing. The program is an attractive immigration pathway for would-be immigrants because it is less stringent, requiring investors to provide evidence of the legality of their source of funds.

Recent reforms to the US Golden Visa

With the passage of new legislation in March 2022 called the EB-5 Reform and Integrity Act (RIA), the EB-5 program has undergone an overhaul. RIA has implemented some key positive changes that make the program more attractive to potential immigrants. One such change is concurrent filing, allowing investors to live and work in the United States while awaiting adjudication of the EB-5 petition. Concurrent filing allows the investor to have legal status in the United States before receiving a green card. Another positive change implemented by the RIA is the introduction of a new reserved U.S. Golden Visa category called the Reserved Visa, which allows for priority processing of applications, resulting in shorter waiting times.

Whether you are an individual planning to start your career in the United States, or a parent planning to send your children to the United States for education, having a green card can greatly help you get one step closer to your goals.

Is Your H-1B Visa at Risk Due to Tech Layoffs?

Given the mass layoffs in the tech industry, many skilled workers living in the United States are at risk of deportation. Most of the professionals affected by these tech layoffs are Indian nationals. Some of them have lived in the United States for decades and would face serious difficulties returning to their countries. Still, they cannot stay in the U.S. without a sponsor, so they have 60 days to either find another employer or have to leave their U.S. home. Many of those affected by these layoffs are turning to EB-5. A green card allows them to continue living in the United States without being dependent on their employer.

Are you planning to start your career in the US?

Known as the Land of Opportunity, the United States is home to one of the largest number of Fortune 500 companies in the world. Going through immigration law multiple times and dealing with a lot of paperwork can keep U.S. employers from hiring international candidates. As a result, green card holders fare better in the U.S. job market than their international counterparts, as employers prefer to avoid the hassle of hiring international candidates.

Do you send your children to study in the United States?

A green card unlocks many educational advantages, including but not limited to:

(1) Tuition fees are lower compared to international students,

(2) have a higher chance of being admitted to U.S. universities and institutions,

(3) better access to paid internships and research opportunities,

(4) Receive government grants and scholarships, and\

(5) Great job opportunities after graduation.

Given all these benefits, many parents are motivated to obtain a US Golden Visa for their children to be educated in the US.

Do you or your family need access to quality health care?

Since the best hospitals in the world are located in the United States, the country provides the highest quality healthcare to its residents. U.S. hospitals are typically well-funded and host world-leading medical innovations and advancements, ensuring patients receive the best possible care and treatment. In addition, the world’s top pharmaceutical companies are headquartered in the United States and have been successful in developing cutting-edge technologies and medicines. With a US Green Card, families can ensure they have access to world-class healthcare.

“The U.S. Golden Visa can dramatically improve a family’s life,” said Shai Zamanian, founder and legal director of the American Legal Center and a prominent advocate for the U.S. Golden Visa. “We are proud to provide active guidance to those who wish to enter the United States to pursue their dreams.”
