Due to recent reforms to the US government’s investment immigration program, the EB-5 Immigrant Investor Program, residents of the UAE and neighboring GCC countries can benefit from priority processing of their US EB-5 Golden Visa. The introduction of a new reserved visa category under the EB-5 program has been particularly effective for Indian and Chinese nationals, who have traditionally had to wait longer due to the high volume of applications from these countries.

What is the US Golden Visa?

The EB-5 program was implemented by the US Congress in 1990 as a way to boost the US economy by injecting foreign capital and creating jobs for Americans. The program requires an investment of $800,000 in eligible government pre-approved real estate projects. Compared to other US immigration pathways, the EB-5 program is one of the fastest and easiest ways to obtain a green card. After about five years, the capital investment is returned to the family.

Recent reforms to the US Golden Visa

With the passage of new legislation in March 2022 called the EB-5 Reform and Integrity Act (RIA), the EB-5 program has undergone an overhaul. RIA has implemented some key positive changes that make the program more attractive to potential immigrants. One such change is concurrent filing, allowing investors to live and work in the United States while awaiting adjudication of the EB-5 petition. Concurrent filing allows the investor to have legal status in the United States before receiving a green card. Another positive change implemented by the RIA is the introduction of a new reserved U.S. Golden Visa category called the Reserved Visa, which allows for priority processing of applications, resulting in shorter waiting times.
