Can I stay in China after resignation?

Abu Dhabi: If you were recently fired or decided to resign from a company in the United Arab Emirates (UAE), how long can you stay in the country?

Suppose you are employed by a mainland company in Dubai. The provisions of Cabinet Resolution No. 1 of 2022 on the implementation of Federal Decree No. 33 of 2021 on the regulation of employment relationships will be implemented.

According to UAE labor law, your employer must first cancel your work permit after you have been fired or resigned.

You need to follow a different procedure for canceling your work permit as per the Ministry of Human Resources and Emiratis (MoHRE) guidelines.

Work Permit Cancellation Procedure

  • Submit the work permit cancellation application through channels designated by the ministry.
  • Complete the required data and attachments.
  • Pay fines (if any) for late issuance or non-renewal of work permits.
  • The institution confirms that the employee has received dues.
  • Other conditions are prescribed by a decision of the Minister or his representative.
  • After completing the above procedures, the employer can cancel your residence visa.

grace period

Once the UAE residence visa is cancelled, you can stay in the country for a grace period of 60 days, harrij times reports.

During this time, you must leave the country or change your status of residence. If you find a new job during the grace period, you can ask your new employer to apply for a work permit and change your residency status before the grace period ends.

Alternatively, after your employer-sponsored residence visa has been cancelled, you can also choose to live in the UAE on a visitor or tourist visa without leaving the country.

However, if you are unable to do so, you should leave the UAE before the grace period ends. Living after the grace period has expired can result in heavy fines.
