Abu Dhabi court orders bank to pay AED98,667 to its customers for unreasonable fees

Abu Dhabi Commercial Court ordered a bank to pay Dh98,667 to a customer who obtained a credit card from the bank and paid all dues, but the bank charged him unreasonable fees, interest and penalties.

Details of the case date back to earlier when a client filed a lawsuit against a bank demanding Dh51,000 to be paid to him.

The appellant’s lawyers asked for the appointment of a banking expert and for the bank to pay its client AED 98,667 in addition to the legal fees and expenses.

Lawyers for the bank filed a memorandum asking the court not to have jurisdiction over the case because the card was issued by the Dubai branch and the bank is headquartered in Dubai.

The court clarified that there was no evidence in the case documents that the bank was headquartered in the Emirate of Dubai and that the agreement between the client and the bank was based in Dubai.

The court also noted that the expert report guaranteed by the court proved that the bank agreed to provide the customer with a credit card without charging any interest, and then the bank was obliged to pay the customer AED 98,667 and release the customer from liability. Any debts related to credit cards.

In addition to paying legal costs and expenses, the bank obliged the bank to close the card’s account and hand over to the customer a statement of its liability.
