Emirates Court of Appeal Upholds Earlier Ruling Ordering Man to Compensate Woman for Physical, Mental and Material Damage

An Abu Dhabi resident who was convicted of hitting his ex-wife with a screwdriver and punching her, causing her to lose her front teeth, has been told to pay Dh50,000 in compensation.
The Abu Dhabi Civil Court of Appeal upheld an earlier ruling by the court of first instance, which ordered the man to pay the sum to his ex-wife for the physical, mental and material damages she suffered as a result of the beating.
The woman filed a lawsuit against her ex-husband demanding Dh300,000 in damages, official court documents said.
She said the man hit her in the face and other body parts with a screwdriver and punched her when they were married.
The attacks caused her to lose her front teeth and caused bruises on her face and other body parts.
The domestic violence caused the couple to separate.
The woman had earlier brought criminal proceedings against the man, who was convicted of assaulting her.
She then filed a civil suit against him.
The Civil Court of First Instance had earlier ruled that the man paid Dh50,000 to his ex-wife for her physical, mental and material damages.
However, both men and women took issue with the Court of Appeal.
The man stressed that his ex-wife had already received interim compensation of Dh16,000 in the criminal court ruling, which also included compensation for all damages.
In her appeal, the woman said the damages awarded by Insurance Tribunal 1 were too small compared to the losses she had suffered, and asked for it to be increased to Dh300,000.
However, the court dismissed all their claims and upheld the first instance court’s decision which awarded the woman Dh50,000 for all losses.
Both the woman and her ex-husband have been told to pay their legal bills.
