Bristol adult entertainment petition seen as attempt to ban drag shows

[ad_1]

Bristol – Robert Botelho insists He asked to change the legal definition of “adult entertainment” In the town of Bristol, the ordinance has nothing to do with drag shows. Most members of the town council, many members of the large public audience at Wednesday night’s council meeting and Rhode Island Chapter of the American Civil Liberties Union don’t buy it.

After Botelho presented his case, he spent about four minutes talking about the need for Bristol to adopt a “tighter and modern regulatory definition” of the term “adult entertainment” in order to avoid “attracting or attracting Adults-only entertainment businesses seeking a presence “in Bristol” he said would have detrimental effects on taxpayers, including but not limited to increased crime, sexual assault, sex trafficking and prostitution, decreased property values and reduced business prosperity And the reversal of gains achieved by Bristol Township community policing policy Timothy Sweeney MP cuts to the chase:

“Mr. Botelho, does drag show fall under the definition of adult entertainment you have before us today?”

Botelho replied that it would be up to the council to decide. Sweeney then turned to the town’s attorney for her opinion on whether Botelho’s proposed definition was too restrictive.

“As our current ordinance reflects, the town can legally regulate adult entertainment through zoning,” explained Town Attorney Amy Goins. “But because of First Amendment concerns, we have to be very specific about what is prohibited, and that’s what the current definition does.”

She said the city council could submit the amendment to the attorney’s office for written comments, but also provided a verbal translation of her written comments:

“The current definition does not need to be changed. Also, the proposed definition is ambiguous as to its unconstitutionality … it depends on what you want to do with it – my suggestion is that no action is required.”

Sweeney moved to file the proposed amendment indefinitely, citing the “chilling effect on First Amendment rights,” but other lawmakers suggested filing the proposed amendment rather than filing it in order to get a written legal opinion and learn from a solid legal basis.

Councilor Aaron Ley was blunt in his assessment of the proposed amendments.

“I think everyone knows what’s going on,” Ley said. “It’s about banning drag… It’s especially disturbing that a proposal like this is in front of us when there’s violence against drag performers in this country, and it’s happening a lot in Colorado. After mass violence where people died and many were injured. There are people in the audience here who can never go into a nightclub again without looking back.”

Both Ley and committee vice-chair Mary Parella made comments indicating that they believed Botelho’s proposal was a response to a recent drag incident at a local brewery in February, which Parella was puzzled by because she didn’t think drag shows were ” Adult “entertainment” in the sexual sense of the legal definition in question.

Botelho responded that he submitted his proposal on February 2, well before the February 11 event. Pivotal Brewery Facebook Post 24 January, 27 January and 1 February, but Botelho told the Daily News he had never seen any advertisements for drag events in Bristol and his proposal had nothing to do with it.

He cited sex shops and stores selling pornographic material as examples of the types of businesses he’s trying to provide a regulatory framework to limit, and said his proposal would only mirror the definition of “adult entertainment” in ordinances in neighboring towns like Warren. .

Botelho contradicted Ley during the meeting, which became so heated it drew a rebuke from City Council President Nathan Carloro, who said in exclusive comments to the Newport Daily News after the meeting that Ley and the council The other members deliberately misinterpreted his intentions.

“The advice provided by the lawyers will not provide any type of regulation for a company that wants to come in and put a sex cam kiosk in the center of Bristol. They will not be able to regulate sex shops, novelty shops or anything of that sort,” Bott Slightly told the Daily News. “They’ve completely lost their intentions, the only purpose is what they think is protecting the concept of drag shows, and that’s never even mentioned. It’s clearly an assumption, and an inaccurate one at that, and honestly, it’s Tendency to slander.”

Botelho also claimed at the meeting and later to the Daily News that the town council leaked his name, address and petition to social media ahead of the meeting to spark public backlash, and that he was threatened with phone calls and Threat messages on social media.

“Absolutely not,” Botelho said when asked if he would have a problem with future drag events in town. “Again, I leave it to leadership to manage and regulate these defined parameters. As my civic duty, I simply bring opportunities for my community to have my community leaders align with our neighboring communities while The fact that they are attacking such a – I would say a public servant – shows the degree of partiality Mr Ley and the rest of the town council have put on display tonight.”
