“Can a landlord give a tenant a day’s notice to move out?”

My 22 year old son is a Dubai resident and recently short-term rental of an apartment From September 1st to November 30th from one institution.

On October 31st, he Receive a move notice Effective immediately because the landlord found a Tenants willing to pay higher rents.

My son said he would move out of the property at the end of November under the terms of the contract.

However, the real estate agent said the landlord never signed the lease agreement, so it was invalid.He insisted on my son move out now.

I understand that Real Estate Regulatory Authority (Rera) regulations do not apply Holiday home rental. But it seems unfair to expect my son to move out a day early.

Three points need to be considered here. The first is that the landlord did not sign part of his contract. So the agent rightly believes that the contract is technically void because two or more people are required to sign it to enforce the agreement.

The second part is that your son needs someone, whether he or an agent, to ask the landlord to give you reasonable notice to move out.

I agree that one day’s notice is ridiculous, so the landlord needs to change their stance and give your son at least a week’s notice, if not a full 30 days, which will take you to the end of November.

This makes sense, but given that the landlord hasn’t signed a contract, I’m sure he feels he’s invincible, so it seems like he can go all out and do whatever he wants.

I would ask the agent why the landlord did not sign part of his contract. Completing the paperwork is the agent’s responsibility.

Presumably your son has also paid until the end of November, so if the landlord does not agree, the rent will have to be returned to him.

If that’s the case, I believe it’s very difficult for a landlord to influence your son’s eviction at will.

My advice is to try to hold out until the end of the month before moving out, or at least ask for a reasonable amount of time to find another suitable unit and refund the rent.

One final thing to consider is that Dubai tenancy laws only apply to long-term tenancies, so you will have to find a solution directly with the landlord to end this chapter.

A new owner purchased the condo we currently live in on August 8th and informed us that she intends to sell the property immediately for a profit.

We’ve had a few viewings since then. The condo is listed on some websites so we know perfectly well that she is for sale.

Is the previous landlord’s eviction notice still valid? He gave notice in July before selling the property.

Additionally, the new landlord recently told us that she now wants to move into the property and has made a cash offer to move out immediately. We might reject it because it’s in very small quantities.

She claims to have sold her main residence and says she has nowhere to live, but we know this is false as she owns many properties.

To do this, you will need to file a case with the Rent Dispute Resolution Commission (RDSC) stating your reasons.

It is normal for a new landlord to make a vacancy offer to an existing tenant who is vacant, but as you mentioned, this offer is not to your liking.

Therefore, negotiations should continue. It is normal for new landlords to want to move in on their own, but they must demonstrate that they have no other suitable alternative property to replace.

So, if you say she owns other units, it goes against the spirit of the law, because you are going to leave falsely.

I’ll focus on this to emphasize the need for correctness in this matter.

I recommend that you organize a meeting with the new owner to explain your situation and explain what is allowed by law.

If all else fails, you may have no choice but to seek redress by filing a lawsuit with the RDSC.
