UAE: Sheikh Maktoum approves formation of Dubai Supreme Court commissioner

Dubai: To further strengthen the Emirate’s judicial system in line with the vision of His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, Vice President Sheikh Mohammed bin Rashid Al Maktoum Bin Rashid Al Maktoum, Ruler of Dubai, Deputy Prime Minister and Minister of Finance of the UAE, and Chairman of the Dubai Judicial Council has approved the formation of a Commissioner of the Supreme Court of Dubai, which will increase litigation safeguards and help boost Confidence in the courts Dubai’s judicial system.

Sheikh Maktoum said: “Establishing an advanced judicial system is the top priority of His Highness Sheikh Mohammed bin Rashid because justice is the foundation of stability and prosperity in a country where the rule of law prevails. We safeguard the rights of the people fairly, effectively and impartially. Competence makes our judicial system one of the best in the world. In Dubai, justice is the right of everyone, without exception or prejudice.”

“Our aim is to invest in Emirati talent to further strengthen the judicial system according to the highest international standards. As an important addition to the Supreme Court, the Council will further strengthen existing mechanisms to uphold justice and strengthen the foundations of stability, prosperity and development, which is the key to shaping a bright future,” he added.

The Board of Commissioners will be responsible for ensuring that the rights of all litigants are protected and that justice is delivered. Board members are well qualified to appreciate and better understand the finer points of various litigation cases. The board will also provide an informed opinion based on evidence and witness statements rather than individual judgement.

The role of the Board of Commissioners includes reviewing appeals before they go to the Cassation and expediting proceedings in appeal cases that do not require an appearance in the Cassation. The committee will help judges spend time reviewing and studying appeals in the context of their judgments. The Board of Commissioners will also be responsible for training and accrediting its judges so that they can be appointed to the Supreme Court in the future.

The committee will examine the appeal, examine cases brought before the Supreme Court, offer settlements to the parties to the appeal, and certify abandonment of proceedings and other events affecting the continuation of the appeal or the determination thereof. The Committee will also issue its opinion on applications submitted to it by the President of the Supreme Court or the heads of divisions of the Court.

Taresh Eid Al Mansouri, Director-General of Dubai Courts, said: “The establishment of the Commissioner’s Council of the Supreme Court of Dubai further establishes the principles of justice, equality and the rule of law. By ensuring an advanced, efficient and impartial judicial system, it contributes to the sustainable development of Dubai .”

“The board’s role is not limited to improving the proceedings in Dubai; but will be expanded to include qualified judges to later join the Supreme Court, who have gained experience by joining committees operating under the Supreme Court, Dubai’s highest judicial body,” he added.

Support the Emiratization Program

Judge Abdul Qader Mousa Mohammed, President of the Supreme Court, said: “The establishment of the committee will support the Emiratisation plan in relation to members of the Dubai judiciary, especially Supreme Court judges, and strengthen our selection of the best and most qualified judges.

“By optimally performing its role, the Commissioner’s Commission will provide additional safeguards to litigants as the Commission will report legal opinions on appeals before the Supreme Court, further enhance the accuracy of reviewing appeals, and facilitate the Court’s decision on cases in a timely manner. .

“The work of the board will be subject to a special process of judicial scrutiny to ensure that its objectives are achieved,” he added.

Dr Saif Ghanem Al Suwaidi, Secretary General of the Dubai Judicial Council, said: “The establishment of the Commission is part of a series of measures to implement the Dubai Judicial Council. [Sheikh Mohammed] Improving the judicial system and proceedings in Dubai in line with his vision of a just and safe community.

“This step follows a benchmarking assessment designed to identify judicial best practice and the role that commissions and similar bodies in various judicial systems play to ensure the accuracy and thoroughness of sentencing,” he added.

The Supreme Court of Dubai was established in 1988 to unify the application of law in Dubai courts. The Supreme Court does not re-judgment cases brought before lower courts, but rather monitors compliance with the law. If a conflict is brought to the Supreme Court a second time, it will issue a judgment as a subject court rather than a court of law.

The Supreme Court consists of a president and several judges. If the president is absent for some reason, the most senior judge is represented. The courts consist of several departments, including litigation, commercial, real estate and civil departments, among others.
