Kathmandu [Nepal]Jan 28 (ANI): Nepal’s home ministry will remain under Prime Minister Pushpa Kamal Dahal following the Supreme Court’s ruling to dismiss Rabi Lamichhane from his resignation, a statement from the Nepali President’s Office said.
Nepal’s President Bidhya Devi Bhandari’s decision comes after the country’s home minister submitted his resignation to Prime Minister Pushpa Kamal Dahal aka Prachanda on January 27 following a Supreme Court decision.

In a statement, the President of Nepal said that under Article 77(a) of the Nepalese Constitution, Ramishane had resigned as a minister and had asked Nepalese Prime Minister Pushpa Kamal Dahal to take over.
On Friday, Nepal’s Supreme Court disqualified Deputy Prime Minister and Home Affairs Minister Rabi Lamichhane after he was found guilty of presenting “invalid” citizenship certificates to participate in the recent general election. Following the Supreme Court verdict, Nepal’s home minister handed in his resignation to Prime Minister Pushpa Kamal Dahal.
The verdict was delivered by constitutional judges of Nepal’s Supreme Court led by Acting Chief Justice Hari Krishna Karki. Other judges sitting on the bench are Justices Bishowambhar Prasad Shrestha, Ishwar Khatiwada, Ananda Mohan Bhattarai and Anil Sinha.

“As a non-citizen, I have nothing to say,” Ramehan told reporters as he walked out of the interior ministry after the Supreme Court’s verdict on Friday night. However, he welcomed the decision of the country’s highest court. “I welcome and accept the SC’s decision,” he said.

Announcing its judgment on Friday, the SC said Lamichhane can regain citizenship through due process, which involves filling out an application form at the district administrative office.
On December 14, supporters Yubaraj Poudel and Rabiraj Basaula filed a writ petition in the Supreme Court, arguing that Lamichhane cannot continue as a member of Parliament because he does not have Nepalese citizenship. The petitioners demanded that Ramichane be removed as party chairman.
Their petitioners say only Nepalese citizens have the constitutional right to vote in elections, stand as a candidate or form a political party in the country. The petitioners further argued that Ramehane’s positions as MP and party chairman were illegal. (Arnie)
