Couple fined Dh500,000 for buying car with fake check in Abu Dhabi

The Abu Dhabi Family, Civil and Administrative Court has ordered a couple to pay Dh500,000 for fraudulently buying someone else’s car using a forged check that could not be cashed and using false names.

Earlier, a car owner filed a lawsuit asking the court to order the trio to pay him Dh405,000, the price of their stolen car, plus Dh100,000 and 12 percent interest as compensation.

He explained that after he sold his car on the electronic platform, he got a call from a woman who negotiated a price with him, but he insisted on the price he offered, he said.

“The woman told him that her husband agreed to buy the car. When the woman came to see the owner, she told him that her husband could not come and asked her to hand him the check,” the owner added.

Subsequently, the car was transferred to her husband’s name, and the owner received her check.

Later, the husband transferred the ownership of the car in the name of a third person, but when the owner tried to cash the check, it was found to be forged, so the police and a lawsuit were filed and the couple were convicted.

The court clarified that two defendants – the wife and a third – had been proven guilty of participating in the defrauding of chattels under false names with unknown persons. The court said the couple, along with another unidentified person, were involved in using a false name to defraud the plaintiff’s car.

Plaintiff thus suffered material harm from being deprived of the car, not to mention moral harm, including feelings of sadness, grief and regret.

Based on this, the court held that Dhs500,000 to the plaintiff as compensation for all the above material and moral damages was sufficient.
