A Florida couple suing OceanGate CEO Stockton Rush has announced they are dropping their lawsuit in the wake of the Titan tragedy. The Titan submersible implodes catastrophically, killing five passengers. Stockton was killed along with British billionaire Hamish Harding, French diver Paul Henri Nargiolet and Pakistani businessman Shahzada Daoud and his son Suleiman.
Marc Hagle and Sharon Hagle reportedly filed the lawsuit in February after Stockton refused to return more than $210,000. The couple said they spent the money on an expedition scheduled for 2018, according to court records.
Shortly after the Titan tragedy, the Winterparks issued a statement saying: “Like most of the world, we have watched the reports of the Ocean Gate Titan capsule with great concern and our hearts go out to the families who lost loved ones. The Hagels paid a $20,000 deposit for the Cyclops 2 diving expedition and are due two more payments. However, they suspected in September 2016 that the dive would not take place immediately and might be delayed. They then demanded a refund.
OceanGate is said to have assured them that they will refund the money if the dive is delayed. The Hagels said they received a new contract in January 2018 requiring them to pay the full cost of the expedition, which by then had been renamed Titan.
When subsequent expeditions were canceled multiple times, they demanded a refund, but OceanGate allegedly told them they would only get a refund if the Hagels took part in the July 2021 expedition. The company also told the couple they would deposit the money in a separate escrow account, but allegedly did not follow through on that promise.
